Court Stops Emir Sanusi’s Reinstatement

A Federal High Court sitting in Kano has granted an ex-parte order stopping Governor Abba Yusuf of Kano from reinstating Emir Muhammadu Sanusi II.

The order also kicked against the abolishment of four emirates: Bichi, Gaya, Karaye, and Rano, in a bill earlier passed by the state house of assembly on Thursday.

It directed all parties involved to maintain status quo ante pending the determination of the suit filed by Sarkin Dawaki Babba, Aminu Babba-Dan’Agundi on Thursday.

Justice Liman granted leave to the Plaintiff/Applicant to issue and serve their concurrent originating motion as well as all other court processes on the 6th Defendant (IGP) in FCT Abuja and outside the jurisdiction of the Honourable Court.

The defendants in the suit include the Kano State government, the Kano State House of Assembly, the Speaker of the State Assembly, the Kano State Commissioner of Police, the Inspector General of Police, the Nigerian Securiy and Civil Defence Corps, and the Department of State Security.

Justice Liman said that all parties are hereby ordered to maintain status quo ante in the passage and assent of the bill.

“That parties are hereby ordered to maintain status quo ante the passage of
and assent of the bill into a pending hearing of the Fundamental Rights application.

“That In view of the Constitutional and Jurisdictional Issues apparent on the
face of the application, parties shall address the Court on same at the hearing of the
Fundamental Rights application which is fixed for the 3rd of June, 2024.

“That in order to maintain the peace and security of the state, an Interim Injunction of this Honourable Court is granted restraining the Respondents from enforcing, executing, implementing and operationalizing the Kano State Emirate Law Council (Repeal) Law.

“That parties are hereby ordered to maintain status quo ante the passage and assent of the bill into pending the hearing of the Fundamental Rights application.

The judge adjourned the case to June 3, 2024, for a hearing of the Fundamental Rights application.

Grassroots Parrot had reported how Governor Abba Yusuf had on Thursday officially announced the re-appointment of Emir Sanusi shortly after signing a new bill on the Kano Emirate into law.

He performed the signing at the government house before the Speaker of the Kano State House of Assembly, Hon. Ismaila Falgore, and other principal officers of the house.

Governor Yusuf also issued 48 hours to Aminu Ado Bayero and four other former first-class chiefs to vacate the palace and hand over all emirates property to the office of the deputy governor.

The new law passed on Thursday by the Kano State House of Assembly abolished the five emirates established by former Governor Abdullahi Umar Ganduje.

While signing into law, the governor expressed satisfaction that the new law will bring unity to the people of Kano and foster sustainable socio-economic development.

He said the return of Emir Sanusi will propel peace and prosperity and restore the lost glory of the state and its rich cultural heritage.
