The Federal High Court in Kano has ordered Kano State Hisbah to produce the controversial TikToker, Murja Ibrahim Kunya before the court in one hour.
The court at the last hearing granted an exparte application directing the board to produce Kunya for an enforcement of her fundamental right.
However, the Hisbah later failed to comply with the order, citing late service of the process.
Kunya is challenging the Hisbah Board, Kano State Attorney General and Commissioner for Justice, and Sharia court Judge, Kano State for violation of her rights.
At the resumption of hearing on the originating matter on Thursday, counsel to Kunya, Barr. Y. A Farege drew the attention of court to Hisbah’s flagrant disobedience to court order.
The applicant’s lawyer argued that the board has refused to produce his client despite the order of the court, an action he claimed is already infringing on the right of the applicant.
Reacting, counsel to all the respondents, Barr. H. H. Sulaiman, a Deputy Director Civil Litigation, told the court that he had formerly requested for the release of the applicant from the custody and still waiting for compliance.
Although, the court suggested that the applicant lawyer should move the application on the substantive motion, pending when Kunya is produced. But counsel to Kunya however pleaded on the court to stand down the matter for one hour for the respondent to produce the applicant.
Justice A M Liman however granted the orally appeal and subsequently ordered Hisbah to produce the controversial TikToker before the court by 2pm.
